What This Position Is All About :

The Senior Manager, Associate Labour & Employment Counsel ensures that the organization is well-supported regarding legal risk management and that legal service is effectively and efficiently delivered, providing added value to the operation of the business across Canada.

This role works to ensure that HBC is well-positioned from a legal standpoint whenever there are changes to the business or legislative or regulatory changes.

Who You Are :

  • You are able to identify business risks and to develop mitigation strategies.
  • You have strong presence with relationship building skills, and are able to communicate effectively with senior management across numerous departments.
  • You present well in front of all levels of management and external business partners.
  • You should be a highly driven and results oriented individual, comfortable in a dynamic, fast-paced, and changing environment.
  • You have proven time management skills and are comfortable managing multiple projects and dealing with shifting priorities.
  • A natural problem-solver, who is also intuitively analytical and attentive.
  • You Also Have :

  • 3-5 years of working experience obtained in the employment / labour group of a top-tier law firm, reputable employment / labour boutique or in-
  • house in employment legal department (ideally a retail environment).

  • Membership in good standing with the Law Society of Upper Canada, with demonstrated expertise in labour and employment law.
  • As the Senior Manager, Associate Labour & Employment Counsel, You Will :

  • Provide practical and business-oriented advice on topics such as recruitment, contractual matters, attendance and disability management, performance management, termination, and human rights law.
  • Provide support on all issues related to employment and labour law to various business lines, including HR, Recruitment, Pensions, Benefits, Compensation, Finance, Asset Protection, PR.
  • Apprise senior HR leaders and HRBPs about developing legal issues, strategies and risks relating to legal requirements and opportunities.
  • Manage labour relations on behalf of HBC, including participating in collective bargaining and advising on collective agreements in HBC stores and distribution centres.
  • Collaborate with Asset Protection on annual compliance matters.
  • Draft and review HR policies on all employment related matters.
  • Research and interpret common law developments, advise HRBPs regarding their potential impacts, and develop strategies for remedial action.
  • Litigate small-scale wrongful dismissal and LTD actions, human rights applications, Ministry of Labour complaints, arbitration proceedings on behalf of HBC.
  • Instruct external counsel on large-scale employment and labour litigation on behalf of HBC.
  • Initiate legal action, as may be necessary or required, to safeguard the legitimate interests of HBC.
  • Draft and review offer letters and other legal agreements as required from time to time, ensuring they protect HBC’s interests.
